  5. Consumatorul (Utilizatorul) nu își poate exercită dreptul de retragere din contractul la distanță în cazul produselor care prin natură lor se pot deteriora rapid și deteriorarea este prezentă.

  12. It is preferable that the Consumer's withdrawal statement is sent to the Professional on the same day that the Consumer returns the product to the Professional, or at the latest the next day, so that the Professional can comply with his legal obligations within the deadline.

  13. The consumer assumes at his own risk the shipment of products for which the following "mandatory technical conditions" are not met:

  17. Careful! In order to be able to reimburse the Consumer for the transportation cost, in the case of accepted return, only under the terms and conditions below, the Consumer must keep a copy of the receipt related to the cost of shipping the product.

  18. Careful! The above-mentioned address is the exclusive point for receiving parcels sent by courier. Parcels are not delivered directly!

  19. With the dispatch of the product with the mandatory information written on the transport document and with the fulfillment of the "mandatory technical conditions", the Consumer will send the Professional the decision to withdraw from the distance contract by accessing the declaration model located on the Professional's website under the name "Unequivocal declaration of withdrawal from the distance contract", which he will complete and send separately for each product he ships to the Professional.

  20. The professional will communicate to the Consumer without delay the confirmation of receipt of the returned product, on a durable medium, usually through the website in which the Consumer has allocated a personal account. Any subsequent communications between the Consumer and the Professional will be made only in writing, on the same durable medium.

  21. If the Professional finds that the present terms and conditions have been respected, then the Professional will refund to the Consumer the full value of the returned product, as well as the value of the transport cost (exclusively) borne by the Consumer for shipping the product. In order to be able to reimburse the Consumer for the transport cost, he must keep and send by email to the Professional, within a maximum period of 48 hours from the date of receipt of the Professional's statement, a copy of the receipt related to the cost of shipping the product.

  22. The counter value to be returned to the Consumer will be transferred directly to the bank account communicated by the Consumer through the website. This account could be debited with a delay of 24-48 hours if it is opened at a bank other than the one providing payments within the website.

  23. If the Professional finds that the present terms and conditions have not been fully respected, and that there are no signs of damage, wear or wear to the products, then the Professional will notify the Consumer of this fact, asking him to comply with the terms and the conditions present within 24 hours from the date of receipt of the notification, in which case the deadline for compliance with the Professional's legal obligations will be postponed accordingly. If the Consumer does not comply with the present terms and conditions within 24 hours from the date of receipt of the notification, the Professional will return the product to the Consumer with a refund of the shipping cost.

  24. The Consumer undertakes to pay the Professional the costs requested by him for the services rendered, necessary to establish whether or not the right of withdrawal is granted as a result of the processing of the Declaration of Withdrawal.

  25. If the Consumer does not pay the Professional these costs within 5 working days from the date of their communication, starting from the 6th working day the Professional will also calculate the cost of the storage service of the returned product, in the amount of 1 leu for each day of storage.

  26. The consumer is advised that in the absence of compliance with the present terms and conditions and in the absence of payment of the costs requested by the Professional for the services provided, the product will be retained as a guarantee by the Professional and will be able to become his property without further formalities from the moment these costs exceed the amount to be refunded to the Consumer.

  27. *) The general and special terms and conditions provided in the present section are consistent with the legal requirements applicable to distance contracts.

  28. **) The consumer can exercise his right of withdrawal from the distance contract concluded with the Professional only in compliance with the present terms and conditions. A Consumer who does not identify with the Buyer can benefit from the right of withdrawal only if he assumes the opposition of the present terms and conditions.
